New Mexico's first-party bad-faith instruction says an insurer deciding whether to pay a claim must act fairly, reasonably, honestly, and in good faith under the circumstances. Does every denied insurance claim involve bad faith?

No. A denial may be reasonable under the policy. The reason, investigation, explanation, timing, and facts require individual evaluation.

How long can an insurance claim take in New Mexico?

There is no single number of days for every claim. New Mexico uses standards such as reasonably prompt communication and a reasonable time after required proof is completed.

Can NM OSI make an insurer pay my claim?

NM OSI accepts consumer complaints and may review possible code issues, but it says it cannot order payment, determine damages, give legal advice, or act as your representative.

What should I send with a first inquiry?
